Subrat SaurabhAuthor of Kuch Woh PalThe multi-party system is only a distortion of the Constitution, resorted to for political gains. Inviting the single largest party head to form governments and the dissolution of governments through no-confidence motions are only malpractices. Change of governments at the centre is done by election or impeachment of the president in the parliament under Article 54 and 61, while it is done by appointing and removing of governors by the president at the states.
The Constitution prescribed that the president shall rule this country (Art. 53) with ministers to aid and advise him (Art. 74). Governors are appointed and removed by the president at his pleasure to discharge the same functions at the states (Art. 155, 156). The prime minister is appointed and removed by the president at his pleasure in terms of Article 75.
The Supreme Court struck down several constitutional amendments made under Article 368 unjustly. Parliament and the president represent Indian democracy and sovereignty. No other authority in the country shall be above sovereign power. PPP and Art. 368 i.e. people, parliament, president and Art. 368 are the basic structures of the Indian Constitution. There is no constitution beyond this. The Supreme Court’s basic structure theory broke the real basic structure of the Constitution.
E. Haribabu
The author, Eeswarapragada Haribabu, has been a chartered accountant in practice in Khammam City in the state of Telangana for the last 34 years. He was qualified C.A in 1985 and completed his degree in law from Kakathiya University in 1990. Later on he completed a PG level course in alternative dispute resolution, conducted by NALSAR University in Vijayawada. He is also an active social worker. He formed an association for the prevention of suicides by farmers in Andhra Pradesh in 1995, having been moved by the plight of small and marginal farmers who were committing suicide. He visited several bereaved families to console them and also rendered financial help for their immediate needs. He interviewed about 1500 farmers from different parts of the Khammam District, compiled the questionnaires and submitted a report in the form of a book to the former chief minister of Andhra Pradesh, suggesting the causes of suicides by farmers, as well as the temporary and permanent measures that should be taken to prevent the suicides. He believes that the Constitution intended only a two-party system and not a multi-party system for the country. He also firmly believes that India is bound to get divided into several countries and lose independence shortly if the distortions are not reversed immediately.
